Understanding the California Divorce Process

Before your divorce — also known as a dissolution — can be made final, the family court will need to resolve any contested issues and approve any settlement agreements that you and your spouse have made. The following are the main issues addressed in divorce cases:

  • Custody and support: If you and your spouse have children, a parenting plan and child support order will need to be put in place in order to provide for their care and support.
  • Property division: In California, most assets and debts acquired during marriage are considered community property and must be divided — usually on a 50/50 basis — in divorce. The issue of who was at fault for your divorce has no bearing on this process.
  • Spousal support: If one spouse has become financially dependent on the other, the court may order temporary spousal support during the divorce and permanent or long-term spousal support — also known as alimony — going forward.
