Understanding Recent Changes to California Law

California's recognition of same-sex couples has undergone dramatic changes — including both expansion and reduction — over the course of the past decade. For dissolution and other family law purposes, however, recent history can generally be divided into two periods.

  • Before January 1, 2005, registered domestic partners only had certain enumerated rights under the law. If you registered your partnership before this date and did not reregister it, your rights may be limited.
  • Beginning January 1, 2005, registered domestic partners gained almost all of the rights and responsibilities of married couples under the California family code.

What Rights Do Same-Sex Parents Have?

It is important to understand that domestic partnership does not create any automatic parental rights. If you are not your child's biological parent and have not gone through the adoption process, your legal rights with respect to custody and visitation may be limited.
